Terms of Service
These Terms of Service ("Terms") govern your use of the Vobbl mobile application ("Vobbl", "the App", "we", "us"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old to use Vobbl. If you are under the age of majority in your jurisdiction, you may only use the App with the involvement of a parent or guardian.
2. Your Account
- You are responsible for maintaining the security of your account (authenticated via Google or Apple Sign-In).
- You are responsible for all activity that occurs under your account.
- You must provide accurate information and keep it up to date.
3. User-Generated Content
"Content" means catch logs, photos, notes, trip data, comments, and anything else you submit to the App.
- You retain ownership of your Content.
- By submitting Content, you grant Vobbl a worldwide, non-exclusive, royalty-free license to store, reproduce, and display that Content solely to operate and improve the App (e.g. showing your catches on your map, syncing across your devices, awarding badges). This license ends when you delete the Content or your account, except for copies already made for backups or shared with other users at your direction, which we will remove or anonymize within a reasonable time.
- You are solely responsible for your Content. Do not upload content that is illegal, infringing, harassing, or that discloses another person's private information without consent.
- If you believe Content on the App infringes your copyright, see our Copyright Policy for how to submit a takedown notice.
- We may remove Content that violates these Terms, and may terminate the accounts of users who repeatedly infringe others' intellectual property rights.
4. Fishing Regulations — Your Responsibility
Vobbl is a logging and planning tool. It is your responsibility to know and comply with all applicable fishing regulations, including but not limited to license requirements, bag limits, size limits, closed seasons, protected species restrictions, and gear restrictions in your jurisdiction.
Any in-app information about regulations, species, limits, or closed seasons is provided for general reference only, may be incomplete or out of date, and is not a substitute for checking official state, provincial, or federal fishing regulations before you fish. 5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to other accounts or our systems
- Interfere with or disrupt the App's operation (e.g. reverse-engineering anti-abuse mechanisms, scraping other users' data)
- Impersonate another person or misrepresent your affiliation
6. Third-Party Services
The App uses third-party services (Supabase, Google/Apple Sign-In, Mapbox, and weather providers) to function. Your use of those integrated services is also subject to those providers' own terms, and we are not responsible for their availability or accuracy.
Maps shown in the App are provided for general reference and trip planning only and are not intended for navigation. Map data (including depth, hazards, and points of interest) may be incomplete, outdated, or inaccurate. Do not rely on in-app maps as your sole means of navigation on the water — use official nautical charts and navigational aids instead.
The App may display advertisements served through third-party advertising networks (such as Google AdMob). We are not responsible for the content of third-party ads or for the products or services they promote. 7. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT WEATHER, SOLUNAR, MAP, OR SPECIES DATA IS ACCURATE OR CURRENT, OR THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOBBL AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP — INCLUDING ANY RELIANCE ON REGULATORY, WEATHER, OR LOCATION INFORMATION, OR ANY INCIDENT OCCURRING WHILE FISHING OR TRAVELING TO/FROM A FISHING LOCATION. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
9. Indemnification
You agree to defend, indemnify, and hold harmless Vobbl and its operator from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your Content, your violation of these Terms, or your use of the App in a way that violates the law or the rights of a third party.
10. Termination
You may stop using the App and request account deletion at any time. We may suspend or terminate accounts that violate these Terms.
11. Changes to the App or Terms
We may modify or discontinue features of the App, and may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
12. Governing Law and Venue
Vobbl is currently operated by an individual, not a corporation, based in Ontario, Canada. These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
Subject to the small-claims-court exception below, you agree that any dispute arising out of or relating to these Terms or the App will be brought exclusively in the courts located in Ontario, Canada, and you consent to the personal jurisdiction of those courts. Either party may instead bring an individual claim in small claims court where eligible.
Class action waiver: To the extent permitted by applicable law, you and Vobbl agree that any proceeding will be conducted only on an individual basis and not as a class, collective, or representative action. You waive any right to participate in a class action lawsuit, to the extent such a waiver is enforceable in the relevant jurisdiction.
Time limit to bring claims: Any claim arising out of or relating to these Terms or the App must be filed within one (1) year after the claim arose, or it is permanently barred, to the extent permitted by applicable law.
(This section assumes an individual operator resident in Ontario, no business entity yet formed. If a business entity is later incorporated, this section should be revisited — the operator's identity, and possibly the governing jurisdiction, will change.)
